Terms of Service

These Terms of Service ("Terms") govern your access to and use of the eCard platform, website, NFC products, and related services provided by eCard Inc. ("eCard", "we", "us", or "our"). By creating an account or using any part of the Services, you agree to be bound by these Terms.

If you do not agree, do not access or use the Services.

1. Eligibility

You must be at least 16 years old and capable of entering a binding contract to use the Services. By agreeing to these Terms, you represent that you meet these requirements. If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Account Registration

  • You must provide accurate, complete, and current information when registering.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately at support@ecard.com if you suspect unauthorised access.
  • You may not share your account or create multiple accounts to circumvent limits or bans.

3. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any regulations.
  • Post content that is defamatory, obscene, harassing, or infringes third-party intellectual property rights.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Attempt to gain unauthorised access to any part of the Services or related systems.
  • Use automated bots, scrapers, or scripts without our prior written consent.
  • Reverse-engineer, decompile, or disassemble any component of the Services.
  • Transmit viruses, malware, or other harmful code.
  • Resell or sublicense the Services without authorisation.

4. NFC Cards and Physical Products

  • Physical NFC cards are subject to separate fulfilment terms communicated at checkout.
  • Shipping times are estimates and not guaranteed.
  • Defective or incorrectly printed cards may be replaced within 14 days of delivery — contact support@ecard.com with photos.
  • You are responsible for the content you program onto your NFC card.

5. Intellectual Property

All content, trademarks, logos, and software comprising the Services are owned by or licensed to eCard Inc. and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Services for their intended purpose.

You retain ownership of content you upload to your profile. By uploading content, you grant eCard a worldwide, royalty-free licence to host, display, and distribute that content solely to operate the Services.

6. Subscriptions and Billing

  • Paid plans are billed monthly or annually in advance.
  • All fees are non-refundable except as required by law or expressly stated in our refund policy.
  • We may change pricing with 30 days' notice. Continued use after the effective date constitutes acceptance.
  • Failure to pay may result in suspension or termination of your account.
  • Taxes may apply depending on your jurisdiction.

7. Termination

You may cancel your account at any time from your account settings. We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the Services ceases immediately.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO ECARD IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Governing Law

These Terms are governed by the laws of Nepal, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Kathmandu, Nepal. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

11. Changes to These Terms

We may update these Terms periodically. We will notify you of material changes via email or in-app notice at least 14 days before they take effect. Your continued use after the effective date constitutes acceptance of the revised Terms.
